These Terms & Conditions apply to all purchases and use of the website operated by Rubber Elite. By accessing this website and/or placing an order, you agree to be bound by these Terms.

Company Information

Rubber Elite operates this website and online store.

Applicability

These Terms & Conditions apply to all offers, orders and agreements concluded via the website. Any deviations are only valid if agreed upon in writing.

Products

We make every effort to display products as accurately as possible. However, colors, materials and appearance may vary slightly depending on your device settings. All products are subject to availability. We reserve the right to discontinue or modify products at any time.

Prices

All prices are stated in EUR and include VAT unless stated otherwise. We reserve the right to correct pricing errors, typographical errors or obvious mistakes. If a pricing error is identified after an order is placed, we may cancel the order and refund any payment made.

Orders and Contract Formation

An agreement is concluded when:

• You place an order, and
• We confirm acceptance of the order via email, and
• Payment has been successfully processed.

We reserve the right to refuse or cancel orders in cases of:

• Suspected fraud
• Payment authorization failure
• Incorrect pricing
• Abnormal order volumes

Payment

Payments are processed securely via Shopify Payments and supported methods such as iDEAL, Klarna and PayPal. We do not store complete payment card details. If payment is not successfully completed, the order will not be processed.

Delivery

We aim to ship orders promptly. Delivery times are estimates and not guaranteed. We are not liable for delays caused by carriers, customs or force majeure. Risk of loss transfers to the customer upon delivery.

Right of Withdrawal (EU Consumers)

Consumers residing in the EU have the right to withdraw from their purchase within 14 days of receiving the goods. To exercise this right, you must notify us within 14 days and return the goods within 14 days thereafter. Returned goods must be unused and in original condition.

The right of withdrawal does not apply to:

• Sealed goods not suitable for return for health or hygiene reasons once unsealed
• Personalized or custom-made products

Refunds will be processed within 14 days after receipt of returned goods.

Returns

Returns must comply with our Return Policy. Customers are responsible for return shipping costs unless the product is defective or incorrect. We reserve the right to refuse returns that do not meet our return conditions.

Refunds

Refunds are issued to the original payment method. We may withhold reimbursement until returned goods are received or proof of return shipment is provided. Partial refunds may be issued where goods show diminished value due to handling beyond what is necessary to establish their nature and characteristics.

Fraud Prevention

We reserve the right to perform fraud checks. Orders may be suspended or cancelled if fraudulent activity is suspected.

Unjustified chargebacks may result in:

• Recovery of administrative costs
• Blocking of future orders
• Legal action where appropriate

Intellectual Property

All website content, including text, branding, images and logos, is the property of Rubber Elite and may not be reproduced without permission.

Limitation of Liability

Rubber Elite is liable only for damages caused by intent or gross negligence, except where mandatory consumer protection laws provide otherwise. We are not liable for indirect or consequential damages. Nothing in these Terms excludes liability where exclusion is not permitted by law.

Force Majeure

We are not liable for failure to perform obligations due to events beyond our reasonable control, including but not limited to natural disasters, strikes, technical failures or government restrictions.

Privacy

Personal data is processed in accordance with our Privacy Policy.

Governing Law

These Terms & Conditions are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in the Netherlands.

Amendments

We reserve the right to modify these Terms & Conditions at any time. The latest version will always be available on our website.
